Philip Doheny, of Raggetstown, Ballinakill, used the tag number of a farmer he claimed to have permission from, in order to sell two heifers for €1,422 on March 12 last year. The money was never paid over to the Ballinakill Livestock Mart, Kilkenny Road, Ballinakill.

Defence, Mr Declan Breen said his client suffers with a huge alcohol problem and there is a very real concern for his well being.

The matter was put back to October 11, for the repayment of €1,400. If all money is paid by that date, Judge Staines said she would impose a suspended sentence.
