Garda William Whelan gave evidence that Niall Kearney, Apt 3, Block 1, Fieldbrook, Portlaoise, had to be restrained by security staff at the Picnic on August 31. Kearney had quite a bit to drink and wasn’t cooperating with staff, and had to be arrested for his own safety.

Kearney had one previous conviction.

Defence, Ms Josephine Fitzpatrick said her client’s judgement had been coloured by drink.

“He must temper his drinking habits,” she said.

Kearney paid €250 to the court poor box and Judge Paul Kelly applied the probation act.
