A six-month sentence, suspended for two years, and a six-year road ban have been imposed on a Polish national who refused to give a blood specimen to the gardaí.
Sebastian Kedziora, 44 The Green, Kilminchy, Portlaoise, committed the offence at Portlaoise Garda Station, on March 22 this year.
Inspector John Lawless gave evidence that the defendant’s car was observed driving erratically, crossing back and forth on the road. He was arrested and brought to the garda station. A doctor was called, but Kedziora failed to give a specimen of blood.
He had three previous convictions, including drink driving for which he was disqualified.
Defence, Ms Josephine Fitzpatrick said Kedziora took medication and he had been afraid to give blood in case it was alleged he was under the influence of an intoxicant.
