Jail threat for man convicted of theft

A defendant was last week warned that he faced a jail sentence unless he came up with some compensation for the victim of a theft offence committed by him.

Peter Fitzpatrick, 16 Heywood Village, Ballinakill was charged with theft at The Glen, Kilnacourt Woods, Portarlington on June 22, 2012.

Judge Catherine Staines said she would impose a prison sentence unless there was some compensation in court. The defendant bought a car from a woman but never paid her the €3,000 agreed price.

Defence solicitor Declan Breen said his client had sold on the car and then used the funds to buy another car on which he hoped to make a small profit. He intended paying the woman for the car and making a small commission for himself. However, there were mechanical difficulties with the second car. The defendant’s business has since failed.

“He is extremely embarrassed and ashamed. He shouldn’t have used those funds,” Mr Breen said.

Later that afternoon the defendant had €500 in court.

The case was then adjourned to May 22 for the balance of compensation to be paid.
