A four months prison sentence was imposed on a father of two at Portlaoise District Court last week for a third road traffic offence.
Audrius Pukas, 36 Rushall, Shannon Road, Mountrath was charged with failing to provide a sample, no insurance and failing to provide insurance on November 24 last. The court heard the defendant was driving while disqualified.
Defence solicitor, Philip Meagher, said his client is a Lithuanian national who has two children aged 10 and 5.
As the defendant knew he was disqualified he was “very upset and became agitated” when approached by gardai. Mr Meagher said his client drank alcohol on his way back on the journey. “He does apologise for his foolish and reckless behaviour,” he said.
“This is his third conviction,” Judge Catherine Staines said. “I have to ensure other children are protected and not killed”.
The defendant was also disqualified from driving for ten years, with a further two year driving disqualification imposed on the no insurance charge. The failure to produce charge was marked proven and taken into consideration.
