Abuse ‘kicked off’ in garda station
A PORTLAOISE man who “kicked off” in the garda station after being arrested for public order offences was last week put on probation and ordered to make a donation to the Garda Benevolent Fund.
Before the district court was 20-year-old John McEvoy, with an address at Rathnamanagh, Portlaoise, who was found in a very intoxicated state on Stephen’s Day last year. Garda William Whelan gave evidence that McEvoy was falling around the street and told the gardaí to “f**k off” when they stopped him. He had to be arrested, but things “kicked off” again at the station and he began swearing at the gardaí.
He has previous convictions for road traffic matters.
Defence, Ms Josephine Fitzpatrick said that her client had been out on the night, when his brother became embroiled in an argument. McEvoy and his brother pulled away from the argument and were going up the town when the gardaí stopped him.
“He got aggressive as he didn’t know why he was being arrested,” Ms Fitzpatrick said.
“Has he stopped drinking?” asked Judge Catherine Staines.
“There’s no point in saying he has stopped drinking,” admitted Ms Fitzpatrick. “It was Stephen’s Day and he drank too much.”
Judge Staines put the matter back to May 9 for a probation report, and remanded McEvoy on his own bail of €100. He was further ordered to donate €200 to the Garda Benevolent Fund.
The judge also recommended that McEvoy attend a course to educate himself on alcohol use.
McEvoy also faced road traffic charges relating to a separate incident. He was fined €200 for driving without tax, €300 for no insurance, and disqualified from driving for two years.
