Drove Mercedes at speed
A HUNGARIAN oral surgeon who travelled at excessive speed on the motorway without car insurance was fined at the district court but escaped disqualification, as Judge Catherine Staines ruled she believed he had made a genuine mistake in assuming he was insured to drive.
Bence Kadar, with an address listed at 1st Floor, Medical Suite, Village Centre, Togher Road, was charged with dangerous driving and having no insurance, at Jamestown, M7, Ballybrittas, on January 10.
Inspector Dermot Drea gave evidence that just after midnight, the defendant was observed driving a Mercedes at excessive speed. The gardaí had to pursue at a high speed, although Kadar stopped immediately when he saw the flashing lights of the squad car.
Kadar has no previous convictions.
Defence, Mr Philip Meagher said his client, a Hungarian national who works as a paediatrics oral surgeon, had travelled from London to Dublin airport that night and had to get to Cork. He arranged transport and thought he was insured to drive.
“It was his honest belief he was covered,” said Mr Meagher.
Mr Meagher went on to explain that the vehicle his client had been driving was a saloon Mercedes, a vehicle which was quite powerful but due to the winter tyres the speed was limited. He said that Kadar had driven at speed on a quiet section of the motorway.
“He should have been more aware,” admitted Mr Meagher.
Judge Staines said she accepted Kadar had made a genuine misunderstanding in relation to the insurance and she imposed fines of €300 and €400.
