Four men contest assault
FOUR men have contested a charge of assault causing harm, in which the injured party sustained a broken finger after he was allegedly set upon as he left a fast food outlet with his wife.
Before the court was Mark Brophy, Drim, Mountrath; Joseph Fitzpatrick, 22 Moanbaun, Woodbrook, Mountrath; Paul Fitzpatrick, Clonincurragh, Mountrath; and Mark O’Connor, Aughafan, Castletown. All four were charged with assault causing harm, at Main Street, Mountrath, on November 20 last year.
Inspector Martin Harrington gave evidence that the injured party was leaving a chip shop with his wife when an altercation began between him and the defendants. The inspector said that the victim was set upon and had to take refuge back in the chip shop, sustaining bad bruising to his face and body and a broken finger in the attack.
Defence for the men, Mr Philip Meagher said he had not seen the medical report, but he understood the injured party suffered no fractures to the face nor any loss of consciousness and had not required hospital attention.
However, Judge Catherine Staines read from the garda evidence and informed Mr Meagher that the victim had been admitted to hospital and required general anaesthetic for his injuries.
“The injuries didn’t extend to fractures,” reiterated Mr Meagher. “Besides, the facts of the case are strongly contested.”
The matter was put back to October 18 for a plea or a hearing date and the men were remanded on continual bail.
