Heroin addict’s ‘gruesome’ leg
A HEROIN addict caught with €7,000 of the drug hidden in the petrol tank of his car has been put on probation, after Judge Tony Hunt was shown “gruesome” pictures of the man’s leg which has been damaged due to a medical condition.
Michael Tynan, from Waterford, was arrested at Portnahinch, Mountmellick, on February 12, 2009.
Garda Sgt Michael Ryan, led by State prosecutor, Mr Will Fennelly, gave evidence that a mobile patrol discovered the defendant and three others sitting in a car parked in a laneway. A garda search of the car revealed a small plastic pack of heroin hidden in the petrol cap. Sgt Ryan said the quantity of the drug was 47 grams, with a street value of €7,000.
The court heard that Tynan and the others had come to Port to swap Valium tablets for heroin. Tynan has a number of previous convictions, for drugs and driving offences.
Defence, Ms Geraldine Fitzpatrick explained that the four individuals had gathered up their money to get drugs that night. Ms Fitzpatrick said her client was a heroin addict who had been in a very bad medical condition at the time, so bad that his interview with the gardaí had to be stopped. She told Judge Hunt that Tynan had lost the fibula in his left leg due to the condition, and photographs were handed in to the court which showed the extent of the damage.
Judge Hunt said he would need a probation report on Tynan, considering the defendant’s drug addiction and the “gruesome” photographs.
The matter was adjourned to April 23.
