Poor box donation for arguing couple
A PORTLAOISE couple who argued in the street were last week ordered to make a donation to the court poor box.
Ashling Byrne, 10 Millbrook, and Nigel Walsh, 2 The Hermitage, Borris Road, Portlaoise, were charged with being intoxicated and using threatening behaviour in public, at Millbrook, Tower Hill, Portlaoise, on April 8.
Inspector Martin Harrington gave evidence that gardaí were dealing with a separate incident on Church Street when they observed the defendants arguing on the street. After being directed by gardaí the defendants left the scene.
Later that day, gardaí received a call to attend Millbrook where there was a report of an argument taking place between a man and a woman. When gardaí arrived they discovered the defendants were again arguing in public. During the incident, they were very abusive to the officers.
Inspector Harrington described both defendants as being of good character.
Defence, Ms Josephine Fitzpatrick handed in letters of apology from her clients.
She told the court that Walsh had won €100 on the day from horse racing and the pair went out to celebrate.
Lager led to spirits before an argument ensued, Ms Fitzpatrick said. There were in a poor state when gardaí spotted them near Church Street and after being asked to move they went to Byrne’s house at Millbrook.
“Behaviour like this would be totally out of character for them,” Ms Fitzpatrick said. Ms Fitzpatrick told Judge Staines that both defendants were offering €300 to the court by way of compensation.
Judge Staines noted that they had no previous convictions, had pleaded guilty and had written very comprehensive letters of apology.
“They seem genuine to me,” said the judge. “This a one-off.”
Both defendants handed in €300 for the poor box.
