Roundabout way to cut €100,000 bill

IARNROD Eireann had €100,000 slashed off a development contribution bill to Laois County Council after it built a new roundabout at the entrance to the Railway Station in Portarlington.
Prior to startin the revamp of Port station, one of nine conditions attached to the granting of planning permission on June 19, 2008 was that Iarnrod Eireann should hand over €150,000 to the local authority.
The reason for this ‘special contribution’ was to cover the expenditure that was to be incurred by the Council in respect of the provision of three roundabouts that were required to facilitate the proposed development.
However, following an order signed on November 6, ‘08 by Laois County Manager Peter Carey, €100,000 of the €150,000 development contributions associated with the project were waived after Iarnrod Eireann constructed the new roundabout at the entrance to Port station.
Mr Carey made the order by invoking his powers under the local Government Act 2001.
Iarnrod Eireann were initally required to pay the €150,000 contribution in accordance with sub-section (12) of Section 48 of the Planning & Development Act, 2000. And the figure was calculated by using the Wholesale Price Index (Building & Construction).
