Portlaoise District Court
A social worker admitted punching a man in the face in Portlaoise.
Derek McNamara (38) of 28 Rathevan Heights, Borris Road, Portlaoise appeared in court accused of assault causing harm at Market Square, Portlaoise on September 1, 2024.
Garda Sergeant JJ Kirby said a man working on security reported that a male had punched a man in the face and the man fell to the ground. He said the injured party suffered a fractured wrist which required surgery. He said the defendant had no previous convictions.
Solicitor Josephine Fitzpatrick said her client was a social worker who did not know the injured party. She said the injured party came out of a fast food restaurant and there was “an exchange” between the pair before the assault and her client has no excuse.
“Had he been sober he never would have behaved in this manner,” said Ms Fitzpatrick.
She said the man works in the disability sector and if a court conviction is imposed it would “sound the death knell” for his employment. She produced a letter of apology from the man and said while he could lose his job the primary concern is the victim.
Judge Susan Fay ordered a probation report, community service suitability assessment and restorative justice. She then adjourned the case back to Portlaoise District Court on April 27.
