Portarlington man stole whiskey and smashed glasses

A Portarlington man who stole a bottle of whiskey from a local pub and later smashed glasses after being refused service has been directed to do community service in lieu of prison.

Paul Casey (25), Derrymore, Portarlington, was charged with criminal damage, and theft.

Inspector Maria Conway gave evidence that at 1.55am on July 5 this year, the accused pushed in the door of the Weighbridge Inn which was not secured and stole a bottle of whiskey valued €40.

Then on July 9, the accused went back into the pub and asked for a drink, but was refused service. He then knocked glasses off the counter and knocked glasses off a table, with €30 of drinks knocked over.

He had four previous convictions.

Defence, Mr Barry Fitzgerald said that his client had an alcohol difficulty and underlying psychiatric difficulties.

Regarding the first offence, the accused had been drinking all day and after closing time he noticed the door to the pub was still open, so he took the whiskey.

He went back into the pub on the second date on an alcohol binge, said Mr Fitzgerald.

Defence said that the accused had €70 in court to cover the loss and a letter of apology for the pub owner.

Judge Catherine Staines said the offence merited a prison sentence, but noted he clearly had an alcohol problem and underlying mental difficulties.

Before sentencing, the judge put the matter back for a probation report and community service report, recommending 150 hours’ community service in lieu of six months in prison.

The matter was adjourned to February 1 next year.
