Judge strikes out Portarlington assault allegation

An alleged assault allegation was struck out at a sitting of Portlaoise District Court. 

James Mulligan (30) of Rathangan Road, Clonbullogue, Co Offaly had been accused of assault causing harm to a female at the apartment above Rhythm N Booze, Spa Street, Portarlington on March 14, 2025. 

Solicitor Michael Byrne told a sitting of Portlaoise District Court that the matter had been listed for DPP directions. 

Garda Sergeant Jason Hughes said “directions are not available. The State would be looking for another six weeks”.  He said the matter was complex as there was a counter allegation. 

Mr Byrne said “my instructions are, he is a victim in this alleged incident”. 

“My application is for a strike out. This has been hanging over” him, said Mr Byrne. 

Sgt Hughes again said the matter had been complicated by counter allegations. 

Judge Susan Fay said “I am going to strike out but noting it can be reentered”.
