The charges were struck out at Portlaoise District Court

A Judge struck out a case against a man who is accused of having drugs and obstructing Gardaí in Portlaoise.

James Kelly (31) of 387 Market Mews, Portlaoise, was accused of having drugs for sale or supply and obstruction of Gardaí at his address on September 9, 2025.

Solicitor Josephine Fitzpatrick said the case was before Portlaoise District Court for directions but they weren’t available.

“I would ask for the matter to be struck out,” she said. She told Judge Andrew Gubbins that her client had already consented to a lengthy adjournment for directions. “It is marked peremptory,” said Ms Fitzpatrick.

Garda Sergeant JJ Kirby acknowledged it was marked peremptory but he asked for another adjournment.

Judge Gubbins noted that the State wasn't in a position to advance the case as he struck it out.
